are covered by the legal warranty of conformity provided for in Articles 128-135 of the Consumer Code ("Legal Warranty").

To whom the Legal Guarantee applies

The Legal Warranty is reserved for consumers (see art. 3, paragraph 1, lett. a) of Legislative Decree September 6, 2005, n. 206 - "Consumer Code"). It, therefore, applies, only to users who have made the purchase on the Site for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out. To those who have purchased on the Site and who do not have the quality of consumers will be applied the warranties for defects in the thing sold, the warranty for defects in promised and essential qualities and the other guarantees provided by the Civil Code with their terms, forfeitures and limitations.

When the Legal Guarantee applies

The seller, and therefore with respect to purchases made on the site, T-Data S.r.l. ("T-Data S.r.l.") is liable to the consumer for any lack of conformity that exists at the time of delivery of the product and that becomes apparent within two years of such delivery. The lack of conformity must be reported to the seller, under penalty of forfeiture of the warranty, within a period of two months from the date on which it was discovered.
Unless proven otherwise, it shall be presumed that the lack of conformity manifesting within six months of delivery already existed on that date, unless such assumption is inconsistent with the nature of the product or the nature of the defect. From the seventh month, it will be the user's burden to prove that the defect already existed at the time of delivery.
In order to be eligible for the Legal Warranty, the user must provide proof of the date of purchase and delivery of the good by retaining the order confirmation e-mail or the purchase invoice (or other documents evidencing the date of making the purchase and delivery).

What is conformity defect

A lack of conformity exists when the purchased goods:
1. is not suitable for the use for which goods of the same type are customarily used;
2. does not conform to the description made by the seller and does not possess the qualities presented as a sample or model;
3. does not have the usual qualities and performance of goods of the same type that the consumer can reasonably expect, including on the basis of advertising statements or labeling;
4. is unsuitable for the particular use communicated to and accepted by the seller at the time of purchase.
Excluded from the scope of the Legal Warranty are any failures or malfunctions due to accidental events, user responsibility, or use not in accordance with the intended use or the accompanying technical documentation.

Remedies available to the user

In the event of a duly reported lack of conformity, the user shall be entitled:
- primarily, to repair or replacement of the goods free of charge, at the user's option, unless the remedy sought is impossible or excessively burdensome compared to the alternative;
- secondarily (if repair or replacement is impossible, excessively burdensome, not carried out within a reasonable time or previously carried out causing significant inconvenience) to a price reduction or termination of the contract, at the user's option.
The remedy is considered excessively onerous if it imposes expenses on the seller that are unreasonable compared to reasonable alternatives, taking into account the value of the goods without the defect, the extent of the defect, and the possibility of an alternative remedy.

What to do when there is a conformity defect

If a product purchased on this Site manifests a lack of conformity during the period of validity of the Legal Warranty, you must follow this procedure:

1. Fill out the form on the contact page, entering the requested information.
2. If the defect is visible, attach photographic documentation; if it is not visible, provide a detailed description.
3. Attach a copy of the order confirmation and/or receipt.

T-Data S.r.l. will promptly acknowledge the report and, if the defect proves to be well-founded, will e-mail the return instructions and the "Return Merchandise Code" (RMA), contacting the user to arrange for the withdrawal of the product, at T-Data S.r.l.'s expense.
If the verification excludes the defect, T-Data S.r.l. will notify the user of the arrangements for the withdrawal or return of the product at the user's expense and responsibility.

We recommend that the destination "T-Data_FA Form L1, Strasburg Street 31, 41011 Campogalliano (MO)" be clearly marked on the return package. In addition, the RMA No. must also be prominently displayed on the outside of the package. The user must deliver the package to the courier, according to the agreed terms, and T-Data S.r.l. will verify the presence of the defect upon receipt.
