1. PREMISE: THE ROLE OF FARCHIONI OLI SPA AND T-DATA S.R.L. IN THE PROCESSING OF PERSONAL DATA COLLECTED THROUGH THE SITE WWW.FARCHIONI1780.COM

The following information is intended for all subjects who make purchases on the following e-commerce site: WWW.FARCHIONI1780.COM 

The Site is the property of FARCHIONI OLII SPA ("FARCHIONI"). The Site is managed, on behalf of FARCHIONI, by T-DATA S.R.L. ("T-DATA"), which sells the products of Farchioni Olii SpA; Mastri Birrai Umbri S.S; Terre De La Custodia S.S. Azienda Agraria; La Valletta Colfiorito Srl marketed on the Site.
T-DATA S.R.L. is in charge of the management of sales and transactions performed through the Site (for example: management of orders, sale and delivery of products, management of returns and legal warranty and other activities necessary for the sale of products through the site). FARCHIONI provides the services that allow access, navigation and registration to the Site. FARCHIONI OLII SPA and T-DATA S.R.L. will process the personal data provided by you for the registration to the site and, respectively, for the conclusion of the purchase contract through the Site as autonomous holders (each, an "Autonomous Holder" and jointly "Autonomous Holders"), in accordance with EU Regulation 679/2016 (the "Regulation") and Legislative Decree 30 June 2003, n. 196 (the "Privacy Code").
In particular:

- FARCHIONI will process your personal data, as Autonomous Holder, in order to manage access to the services of the Site and facilitate the purchase of products online as well as to allow your registration to the Site and the possible conclusion of the purchase contract, subject to your consent, also for marketing purposes;
- T-DATA S.R.L. will process your personal data, as Autonomous Controller, to enable the conclusion of the purchase contract, to execute the obligations arising from such contract, to fulfill all legal obligations, including tax and administrative obligations, as well as for other purposes related to such contract and / or the execution of pre-contractual measures, as described in this notice;
The treatments carried out by FARCHIONI, as Autonomous Holder, are described in the Privacy Policy of FARCHIONI, to which we refer entirely, made available in the footer of the site at the link "Privacy policy FARCHIONI OLII SPA".
This information is therefore made with reference only to the processing carried out by T-DATA S.R.L. as Autonomous Holder.

Further Information:
The provision of data for the purpose in question is optional: there is no legal or contractual obligation to communicate the data; it is, however, a necessary requirement for the conclusion of the purchase contract through the Site. Failure to provide the data will therefore make it impossible for the user to conclude such a contract and thus make purchases through the Site.

T-DATA S.R.L. is the Autonomous Data Controller of the data you provide when concluding a purchase contract through the Site, for the purposes set out in Sections 4, 5, 6, 7, 8 and 9 of this policy. 3. DATA PROCESSING BY T-DATA S.R.L. FOR PURPOSES OF CONCLUSION AND EXECUTION OF THE PURCHASE CONTRACT

T-DATA S.R.L., as Autonomous Controller, will process your personal data:
- to enable the conclusion of the purchase contract through the Site (e.g.: loading products into the shopping cart and choosing the payment method);
- to execute the obligations arising against T-DATA S.R.L. deriving from the contract, such as, by way of example, the delivery of the products sold;
- to enable you to perform your obligations arising from the purchase contract concluded through the Site, such as, without limitation, the online payment of the products purchased;
- to give effect to pre-contractual measures requested by you (e.g., notification of the availability of a product).
The legal basis for this processing is the performance of the contract (Art. 6.1.b of the Regulations). For this purpose, T-DATA S.R.L. will process your data for the time strictly necessary for the performance of the activities (e.g.: until delivery of the product or, in case of non-delivery, until the termination of the contract), it being understood that, once this term has expired, T-DATA S.R.L. may retain the data for the purposes and for the maximum periods provided for in sections 4, 5, 6, 7, 8 and 9 of this policy and/or, in any case, in the cases established by the Regulations or by law.

Further Information:
The provision of data for this purpose is optional: there is no legal or contractual obligation to communicate the data; however, it is a necessary requirement for the conclusion of the purchase contract through the Site. Failure to provide this information will result in the impossibility for the user to conclude the contract and thus make purchases through the Site. 

4. DATA PROCESSING BY T-DATA S.R.L. FOR CUSTOMER CARE/CUSTOMER CARE PURPOSES

T-DATA S.R.L., as Autonomous Data Controller, will process users' data for assistance and customer care activities, to respond to requests for information, complaints, reports and disputes relating to online orders.
The legal basis for this processing is the execution of pre-contractual measures taken at the request of the data subject (art. 6.1.b, last paragraph, of the Regulations) or, as the case may be, the legitimate interest of T-DATA S.R.L. (art. 6.1.f).
The user has the right to object to this processing by contacting T-DATA S.R.L. by email (supporto@t-data.it) or at the operational headquarters.

5. PROCESSING OF DATA BY T-DATA S.R.L. FOR PURPOSES OF FRAUD PREVENTION IN THE CASE OF PAYMENT BY CREDIT CARD

T-DATA S.R.L., as Autonomous Holder, will process users' personal data for credit card payments, managing and possibly blocking fraudulent transactions. The data processed include those related to the order and of the card holder, if T-DATA S.R.L. requires, to ensure the security of payments, a copy of the card (as indicated in the general conditions of sale). The processing does not concern confidential card data (number, expiration date, security code) acquired directly from the payment service provider.
The legal basis is legitimate interest (Art. 6.1.f).
The user has the right to object to this processing by contacting T-DATA S.R.L.

6. DATA PROCESSING BY T-DATA S.R.L. FOR ADMINISTRATIVE-ACCOUNTING AND TAX PURPOSES

T-DATA S.R.L., as Autonomous Holder, will process users' data in order to fulfill administrative, accounting and tax obligations related to the purchase contract (e.g. keeping of accounting records, issuance of sales invoice).
The legal basis is the fulfillment of legal obligations (Art. 6.1.c).
The provision of data for this purpose is mandatory; failure to provide it will prevent the conclusion of the contract.

7. PROCESSING OF DATA BY T-DATA S.R.L. IN ORDER TO ENABLE THE USER TO EXERCISE RIGHTS

T-DATA S.R.L., as Autonomous Controller, will process users' data to:
- Respond to requests to exercise the right of withdrawal, legal guarantee of conformity or other rights related to the purchase contract;
- Perform necessary activities consequent to the exercise of such rights (e.g., refunds);
- Handle requests related to data protection rights.
The legal basis is the fulfillment of legal obligations (Art. 6.1.c).

8. PROCESSING OF DATA BY T-DATA S.R.L. FOR PURPOSES OF ASCERTAINING, EXERCISING OR DEFENDING A RIGHT

T-DATA S.R.L., as Autonomous Controller, will process users' data for the establishment, exercise or defense of a right in administrative or judicial proceedings.
The legal basis is legitimate interest (Art. 6.1.f).

9. CATEGORIES OF PERSONS TO WHOM T-DATA S.R.L. COMMUNICATES YOUR PERSONAL DATA (RECIPIENTS)

Personal data provided by the user may be disclosed to:

- Group companies to which T-DATA S.R.L. belongs, employees, collaborators and service providers (e.g., consultants, maintenance, cloud computing, logistics support, shipping, Payment Service Providers, couriers, etc.);
- Public authorities or subjects having access to the data by virtue of regulatory or administrative measures;
- Other parties necessary for the fulfillment of contractual or legal obligations.

10. TRANSFERS TO THIRD COUNTRIES

Users' personal data may be transferred by T-DATA S.R.L. to third countries, such as India.
The recipient of such data is Zoho Corporation PVL, LTD (together with Zoho Corporation B.V.) for the Site's chat service.
For transfer to India:
- There is no adequacy decision for the level of protection in India;
- In the absence of such a decision, data may be transferred only if adequate safeguards are provided (e.g., model contract clauses);
- The transfer is made on the basis of the model contractual clauses and the Supervisor's authorizations.

11. RIGHT OF OPPOSITION

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data carried out for the purposes set out in Sections 4, 5 and 8, based on legitimate interest.

12. RIGHT OF ACCESS

You have the right to obtain confirmation that your personal data is being processed and to access this data and related information (purposes, categories, recipients, retention periods, etc.).

13. RIGHT OF RECTIFICATION

You have the right to obtain correction of inaccurate or incomplete personal data without undue delay.

14. RIGHT OF CANCELLATION

Users have the right to have their personal data deleted if the following reasons exist:
(a) The data are no longer necessary for the purposes for which they were collected;
(b) The user objects to the processing for reasons related to his/her particular situation;
(c) The data are processed unlawfully;
d) The data must be deleted to fulfill a legal obligation.

15. RIGHT TO LIMITATION OF PROCESSING

The user may request restriction of processing if:
- Disputes the accuracy of the data for the time necessary for verification;
- The processing is unlawful and the user objects to deletion and instead requests restriction of use;
- The data are necessary to establish, exercise or defend a right in court;
- User objects to processing based on legitimate interest, pending verification.

16. RIGHT TO DATA PORTABILITY

You have the right to receive your data in a structured, commonly used, machine-readable format and to transmit it to another data controller if the processing is based on consent or a contract and is carried out by automated means.

17. TIMING AND MANNER OF RESPONSE IN CASE OF EXERCISE OF THE RIGHTS OF THE DATA SUBJECT

T-DATA S.R.L. will provide information regarding requests to exercise rights (access, rectification, cancellation, limitation, portability, opposition) within one month of receipt of the request, extendable by two months if necessary, informing the user of the reasons for the delay.
If the request is not fulfilled, the user will be informed of the reasons and the possibility of filing a complaint with a supervisory authority.

18. RIGHT TO FILE A COMPLAINT WITH A SUPERVISORY AUTHORITY

Without prejudice to any other remedy, a user who believes that the processing of his or her data violates the Regulation has the right to lodge a complaint with a supervisory authority in the member state where he or she usually resides, works, or where the violation occurred. The supervisory authority will inform the user of the status and outcome of the complaint, including the possibility of judicial redress.
